I'd like to thank you for those links to Bert Hubert's blog, he explains things very very well. And he also includes some fascinating links regarding the explosive use of recitals in EU legislation which was puzzling to me. The problem appears to be the overwhelming majority of people involved in the drafting of EU legislation, from EU institutions to policy experts, don't have any legal training. There is no part of the legislative process that is targeted at improving the legal quality of the texts. Basically, what EU legislation really needs is a good editor to cut out all the fluff, even if the consensus is that the current results are of fairly high quality, just overly wordy.

With regard to the legal discussions on LWN, I think that indicates how much Groklaw is missed.

(The Debian statement was mostly badly timed, the vote being after the trilogue, but before the new draft was published. If it had happened a month or two earlier it would have mattered more.)
