Also there's nothing stopping you breaking Red Hat's rules. They are not law (or backed by law, either!)

All Red Hat can (and will) do is stop doing business with you, as is their right.

I think it must be more nuanced.

How would you view an arrangement where

1. Red Hat gives you the binaries, 10 years of updates and support and a written offer to provide source in exchange for a large sum of money;
2. Red Hat would reserve the right in the contract to terminate the contract and keep the money if you request the source.

?
