SCO's answer to IBM's second amended counterclaims (Groklaw)

Groklaw has a text version of SCO's answer to IBM's second amended counterclaims, along with some commentary from PJ. "This is the happy day that SCO acknowledges by its actions -- although it failed to put out a press release -- that the GPL isn't unconstitutional after all.... They do still claim the GPL is void or voidable, that it is unenforceable, and that the FSF selectively enforces it, so not all the silliness is gone. But they have tucked tail and begun to back down. They are getting their PhD in the GPL, and in time it will gradually dawn on them that they are wrong about all the rest too."

Notably, the fact that SCO "failed to put out a press release" on the GPL's constitutionality is part of a recent pattern. Darl, Chris and Blake have been uncharacteristically silent -- have they heeded Baystar's advice to zip it?

Mark Heise has not enlightened us on his (evidently) evolving theory of constitutional law and copyright -- has he suddenly remembered that he's a lawyer?

I was just about to say that nothing had been entered into WLTSIM since April 1st -- but wait! Darl couldn't resist after all! He's talking to the Salt Lake Tribune! SCO-watchers, breathe easy. The world, and Darl, have started to spin again.

I see that it's a Sunday story already noted in Groklaw, and just now making it into WLTSIM. Worth a read just for the contrast between the hard news up top and D. McB's comment halfway down:

"Our company has never been in a better position and we've never been more committed to our Unix business," he said. "We are preparing major updates of our products. . . . We are confident of our litigation efforts and we are well-funded to achieve many of the goals that we have as a company."

"It's only a flesh wound! Come back here, you coward!"

And check out the photo accompanying the story for confirmation that moral decay can't be kept hidden for long.

Darl has been looking a lot less "crisp" lately. He used to pose for photographs, being the young dashing CEO that he thinks he is (my favorite was the one where he was holding a poker hand staring at an unseen opponent with a stern look on his face... I felt it was hilarious since I have never really thought of Darl being a disciplined poker player; more like one of the suckers if you ask me).

Now it seems like the only interviews he seems to be able to get are the ones with reporters armed with nothing more sophisticated than a vintage 1985-era Poloroid camera.

Soon enough Darl will be seen walking the streets on rainy nights muttering to himself. Its a sad thing to watch grown men go down the tortuous path of madness. Its never pretty, but these things seldom are. The disease is starting to set now. With every turn of the IBM screw the inevitable comes closer. Hopefully Darl has set some money back for his *vacation*. The dogs of war have been unleashed. The train has left the station, and it will stop for no one
