Thanks for the clarification! I'm confused by the article now though. It still refers to the "X.Org Foundation" and "looking at making some fairly small by-law changes". If there is no separate Foundation anymore, do bylaws even exist?

This insofar matters as SPI will head the requests (within their own legal limits) of the official representative of a project. So that's why these "bylaws/constitution" documents do actually matter, but it's entirely up to SPI whether they want to obey them or pick someone else as official representative of a project.
