The cases where the CoC could have been invoked, for example, during the last six months are very few.
What I am reading from the discussion on LKML is that some people consider it would be a daily concern.

The purpose of the CoC is that if bad behavior is during the development of the kernel, there is a process to take care of it and people would not have to deal with it. That you would view the unfortunate bad behavior but you would be confident it will be dealt with.
