I don't think the licence can decide what counts as a derivative work. That is determined by copyright. At most the licence could grant exemptions so that even if something might be considered a derivative work under copyright law, distributing it under other terms is still permitted.

And when the powers that be push for ever-stronger copyright, it has the side-effect of strengthening copyleft.

Of course, without enforcement, it's rather moot.
