Following your logic, you take Linux, you patch it with grsecurity then you can't call it Linux anymore. I still don't see how porting grsecurity to a particular kernel is any different from porting Linux to a platform and still call it Linux.

It would be within the trademark holder's to assert that - for instance, Mozilla refuse to allow you to call anything Firefox if you apply patches without their approval. Linus chooses not to enforce on that basis.
