Reading what you wrote about the memcmp flaw rather more closely, it is obviously a hardware issue :-)
Whether the flaw appears depends on what hardware you run it on!
Oh - another definition of software - you can (time taken to do it is discounted) run it on wetware. You can clearly run this memcmp code on wetware :-) and the timing issues (SCIENCE!) will clearly be very different. But if you run it on wetware you can prove it correct! ie it's maths!
