What exacly are FSF doing?

What I don't get is, since FSF don't hold copyright on the driver interface code, what basis would they have for such threats?

From the Forbes article: the Free Software Foundation ... has been making threats to Cisco Systems and Broadcom over a networking router that runs the Linux operating system.

One possibility is that they haven't been making threats at all. Maybe they're just working with them to clear this issue up. When you don't have the grounds to prosecute, and you tell a company that they are breaching contract, you are not threatening, you're informing. Useful info too.
