I'm not seeing that file (I'm running 2.6.39). Does it need to be created?

It'll only exist if your firmware doesn't provide its own passive trip point. If it does, we should already be handling overheat (assuming that the trip point provided by your firmware isn't above your system's critical shutdown threshold, which is obviously possible)
