You are wrong about the European situation: there are large numbers of software patents in Europe (many tens of thousands, if not hundreds of thousands), the courts uphold them, and there's also some litigation going on, such as Apple suing Nokia in the UK and in Germany over 9 European software patents. Also, more fundamentally, patents regulate target markets, not countries of origin. If a company is based in a no-software-patents jurisdiction, it is still affected by them once it tries to serve markets that have software patents.
