Sorry, I have trouble to understand your statement. What is new about licensing software? As far as I can see Google has published an SDK under their own terms and have stated the intention to publish most of the components under the Apache License. As far as I can see they get nice press of being open source, when they in fact are not open source right now and will probably never be for the complete platform. I doubt that the FCC will accept open-source controlled radios on a Google platform.

Doesn't seem very likely that the Linux system would directly control the radio parts. I
pretty much assume a dual chip design, where a proprietary GSM/UMTS/CDMA/whatever chip is
separate, interfaced to the application processor.
