Could not he have meant GPL software when he wrote Free Software, as opposed to Open Source Software? Perhaps if you include X, Perl, and whatever else is not under the GPL, you could hit 50%.

I speculated exactly that in my posted comment. But if MS doesn't
understand the difference, they'll never understand why we oppose this
agreement or how to move toward fixing it.
