Point taken, but in this case they're talking about companies using GPL software in embeded devices. Presumably these devices are being sold and so the GPL software on them is being distributed. So the company is bound by the GPL and must stop distributing if it breaks the license.

In the GPL v3 they're going to make it slightly easier for accidental breaches of the GPL to be corrected without the distrbutor automatically loosing their rights to distribute the software.
