I am not a lawyer, but it sure looks like the OpenSolaris Binary License is not another open source license. It is a pretty darn closed license for stuff without source.

* IPFilter from Darren Reed is included in OpenSolaris. I'm still wondering how the licensing scheme is working with the CDDL.
* It seems that you still need the Sun proprietary compiler to compile it. It seems they are planning to release files to make it compile in GCC.
* You still need a proprietary license to get the binary build of OpenSolaris. That's strange, is the express version more than a simple build ?
* Grub is in the source solaris tarball ;-). I'm still wondering why they don't make the CDDL compatible with the GPL.

Best quote ever, in the bottom of the page: "Our lawyer is making us say that OpenSolaris is a trademark of Sun Microsystems, Inc."OpenSolaris is out
The download page says:OpenSolaris is out
Some binary components are covered under the OpenSolaris Binary License and some are covered under other open source licenses.
Some basic and quick comments from what I saw :OpenSolaris is out
