Thanks; it's good to get some actual legal advice here.

But this also creates an incentive pushing folks to releasing advertising-supported (and/or datamining-supported) applications.

Wouldn't the CRA make app developers liable for ad network-delivered malware or other such things? Maybe that will at least get the ad networks to start being liable for the crap they shuffle around or app developers to at least start selecting more trustworthy ones (not that I'd trust any further than I could throw them, but some I wouldn't want to *touch*).
