I am not a lawyer, of course, but I don't think that's correct. What the customer does or does not do is unimportant.
Red Hat received a license to distribute GPL software under a certain set of conditions. Arguably they are distributing the software under different conditions not allowed by that license.
Maybe it isn't a violation, but what is at issue here is the terms under which RHEL is distributed, not whether customers can choose not to be customers.
The potential grievance is up the stream, not down.
