Interesting point.

However, in my humble (really!) opinion, everyone seems to forget here that modern computer communication technology has definitely changed the situation. The key issue now is not really anymore to question how to prevent a government to monitor their citizens communications: that's technically feasible and law enforcement necessitates it.
The key issue is: how do we control the government in their usage. I would *really* like to know when a government agent and/or a big company and/or neighbour and/or managers performs an operation on files related to me. Full stop. *Only* individuals acting on their own should have a right to privacy; the others should be monitored in the first place.

To summarize: how do we log access to log files?
