A couple weeks ago I wanted to use an LDAP authorization feature (nested group membership). After some investigation and surprise, I found that that feature had been committed to the svn trunk in 2007, but has not yet made it into a release. Why? Because there haven't been any new major versions released since 2.2 was released in 2005, 7 years ago! Yikes! (But, I see 2.4 is expected to be released real soon now.)
The glacial speed of releases probably has nothing to do with licenses, but I would guess that anyone who has forked Apache into a proprietary variant has most likely had no trouble keeping up with the rate of change...so you might want to find a new example to hold up. :)
