If you read Groklaw, you will note that the judge involved was Judge Randall Rader, who normally spends most of his time on the Circuit Court of Appeals, and was a guest judge. (He is normally handling the appeals from all the different courts, having to do with patents). The speculation is the court of appeals understands there is a problem, and was sending a message to the lower court.

In any case, we were very happy to have him as the judge: though obviously fixing the real problem would be a better solution.

We aren't out of the woods yet, in fact, this is just an early round in the wars, unless Bilski changes the equation entirely.
