You've missed the point. If Microsoft (say) end up holding the copyright on part of the kernel, they get to enforce that copyright. If they interpret the GPL as preventing the incorporation of the CDDLed dtrace then they get to sue everyone distributing the Linux/dtrace combination. With that as a possibility, I just don't see any major Linux vendor taking the risk.
