Novell tells court: For SCO bankruptcy is 'inevitable' and 'imminent' (Groklaw)

Groklaw has fun with Novell's latest filings in its suit against the SCO Group. "Now that Novell has been permitted to analyze the Agreements, it is apparent why SCO was hesitant to produce them: they are direct evidence of SCO’s wrongdoing. SCO’s breach of its fiduciary duty to fully inform Novell concerning the royalties it collected from Sun and Microsoft, when requested, can be no defense to Novell’s request for preliminary relief."

It is quite possible to have no good guys in a fight :)

That's even preferable. The net effect tends to be to hurt both of them. Neither Novell nor SCO is going to get anything good out of this.

What is a pity is that it also means IBMs counterclaims are going to be worthless.

SCO deliberately did a lot of damage. They rigthly should pay for that. But they cannot and willnot, since they're gonna be bankrupt before the court eventually does its thing.

For this reason, I hope (but do not believe!) that they actually survive until the verdict falls.

I would *MUCH* prefer: "They sued Linux, the judge called bullshit and they went bankrupt unable to pay the verdict against them."

Instead of: "They sued Linux, and who knows if they migth have won, they went bankrupt before the case ever got trough the courts."

Yeah yeah, I know that you can't and they haven't "sued linux", but most mainstream journalists don't appear to know that. Or atleast didn't a few years back when they first started the entire nonsense.

Assuming it can be shown that SCO acted maliciously
to damage Linux and/or pump their own share price,
then it'd also be nice if a few people went to prison for
it.

Nothing useful. Copyrights to some old unix books - interesting, but not particularly valuable. Copyright to some bits of linux code licensed under the GPL. A few trademarks...

Gee, just a few more months of delay and the glacial U.S. justICE system will have aided and abetted yet another criminal in its criminal endeavors. Novell will be left with a bit of parchment proclaiming they really should have received a dollar or two, 'way back when. Sorry about your luck; justice delayed and all that rot, y'know.

Meanwhile, as the SCOG ship sinks slowly into the muck, and the inSecurities and Exchange-backscratches Commission ignores the executive looters escaping in the life rafts, our other favorite corporate criminal extends its grip on the MS-US with false vistas and inscrutable black boxes masquerading as voting machines. Nothing like a good court battle for diversionary entertainment. Will Chairman Bill allow the MPAA and RIAA (aka, MAFIAA) to continue getting a cut after getting sufficient consumer unit eyes glued to his vista? Will the Chairman allow any doubleplus ungood commentary to come from Trusted Computers? Who will the Chairman elect as President?
