Why are we worried?

Why are we worried?

Parent article: California's Digital Age Assurance Act and Linux distributions

A Federal judge has already ruled in a Texas case that such a requirement without strict definitions is not constitutional for applications. I see no reason why it would suddenly be constitutional for an OS if it is not for applications.

I also see a problem with enforcement if the people, community, foundation, or company creating the OS or device has no presence or direct business in the state of jurisdiction. And what about devices, companies, or distributions that reside entirely outside of the USA? The distributions I use right now are homed in Ireland, France, Greece, and Germany.

I have to wonder if defaulting to the date 1 January of the 10th year previous would satisfy some of these laws? Currently 2016-01-01. (I really do NOT mind if sites I connect with think I am 10.)
