Groklaw looks at some email correspondence by Andrew Tanenbaum on whether early versions of Linux had any Minix code within. "Apparently, Ken was expecting me to find gobs of copied source code. He spent most of the conversation trying to convince me that I must have made a mistake, since it was clearly impossible for one person to write an OS and 'code theft' had to have occured. So, I guess what I want to say is, pay no attention to this man. . ."

IANAL, and I haven't seen the book yet, but it would seem that Linus might have a pretty good libel/slander case against Ken Brown. If Prof. Tanenbaum and Alexey Toptygin told him what they say they told him, and he ignored what they said and published false claims that Linus copied from Minix anyway, then it seems that this would rise to the "reckless disregard for the truth" standard.

On the other hand, Linus might not want to bother with this idiot.

Chris Cox ($11,000 donations from M$) want to attract more campaign
contributions to his republican party from Microsoft? Is that what
it's all about? Or, is is about M$ wanting to sell more software to
the government, and paying AdTI some money for a smear campaign
against M$ competition Linux is one way to the get attention of Cox's
Homeland Security committee?

Does a former CFO of Microsoft on the board of Heritage Foundation
(who hasn't quit microsoft - keeps a VP title) influence Heritage's
programs to get M$'s employee, Homeland Security director on the
program, or is it Becky Dunlap, director of AdTI AND vice president of
Heritage Foundation who decided that?

And what does this have to do with Townhall.com's FUD campaign that is
bigger and going on longer than AdTI's? I mean, really "Is Open Source
Software Equivalent to the Borg?", isn't this rather extreme, or just
extreme-right? Somebody want to explain which factors are more
important: is it covert political control in the name of
"libertarianism"; or billionaires like SCAIFE and GATES just got to
stick together; or is it minions currying favour obsequiously groping
for advancement up a rung on the ladder; or scum-sucking
bottom-feeders oozing out slime from every pore just can't help
themselves? Your analysis on this fuzzy subject is urgently needed.

tapped former US political adviser Thomas Richey for a new position
counselling policymakers on IT issues

Many companies are hoping to get a piece of the homeland security
business, which could provide a windfall to the tech sector. Any new
homeland security department set up by the US government would need to
purchase computer equipment for internal use and would likely promote
new technology to help the United States fight terrorism.

What's more, government officials have said they need more cooperation
from the private sector, particularly because so many of the country's
tech systems are under the control of companies.

Yep. Ken Brown must a humble man to make those kind of calculations.

I can imagine Ken thinking, "If I make up a bunch of lies about Linus, will I get sued? Probably not, I'm too worthless an individual for Linus to bother with. Linus is more bothered by when he steps on gum than by anything I can say about him since he knows that I have a wormlike soul."

You not only need to show reckless disregard for the truth and malice intent but also, this is the hard part, actual harm. Unfortunately (?) I don't think Linus was harmed by the self-destructive act of Ken Brown.

I have to disagree. The man is calling Linus a "copyright infringer". I don't think any of us would like to explain this to out kids, wives, friends, relatives etc. It is real harm. You can go around claiming thing about people that you know are false, not like this.

Understood, but to courts, especially civil, harm is described in terms of dollars. Linus would have to shown that ADTI intentionally set out to cause harm to Linus by willfully publishing lies and deceit. And Linus would need to show how such efforts harmed him finanacially. Now, the harm can be theoretical (receipts not necessary) but I believe it has to be expressed in financial terms. Courts cannot restore reputations or establish "fairness." But a large dollar award to a plaintiff can do a lot to offset the damage to ones' reputation. (I am too familiar with this due to some nasty people who decided to go after friends of mine; they were able to win a large judgement and that helped answer third party concerns based on the libelous claims against them.)

However, Linus' reputation hasn't been scratched; Ken Brown(oser) is exposed as Billy Goates errand boy, but Linux is unscathed. Not that ADTI didn't try hard to publish a hit piece. Kenny Boy just sucks as a researcher and writer. Maybe this even backfires and BENEFITS Linus. Oh, well.

Interestingly, companies in the Linux distribution business may be able to show actual harm to their business by Klueless Kluck Ken. Showing evidence of slowed sales and such via libel can be restraint of trade -- maybe even falling under the Beef Industry protection laws (anti-Oprah laws, remember them?).

Perhaps RedHat needs to expand its suit against SCOX and include ADTI.

Linux could sue for AdTI profits gained from the work. I know for sure copyright infringements are that way. See Title 17 section 504 (b)

Discovering who sponsored the work would also be nice.

Someone on Groklaw mentioned an article by the same author a few years ago was saying that Free Software is the way to go. Someone also commented that the recent paper was written using Open Office, and that AdTI uses Linux to run their operation.
Maybe AdTI just needed the money and wanted to accept a writing job without worrying too much what "bang" their patron got for the "buck". Payroll has to be met and Linux organizations aren't buying too many think tank papers lately.

Except that it would take large amounts of Linus' time to do so, and he can fight the open source fight much more effectively by using that time to work on the kernel. I'm sure he enjoys it more, too.
