Darl McBride-Dan Farber ZDNet Interview - Transcript (Groklaw)

For anybody who hasn't had enough Darlspeak recently, Groklaw has put together a transcript of his interview with Dan Farber. "You have the drug, the biotech, companies. You go and put together a new drug formula, and because it's software and touches GPL, if you're not careful, that gets destroyed. So I think it's a very dangerous setting we're talking about."

Darl and the GPL

When someone holds forth repeatedly and publicly on one subject for over a year, and is still light-years away from having the slightest semblance of a clue about it, we may be excused for suspecting that this is not a handicap, but willful ignorance.

To put Darl's words another way, "You have the drug, the biotech, companies. You go and put together a new drug formula, and because it touches patent law, if you're not careful, that gets destroyed."

If one's software is that valuable, be as careful about software licensing issues as the drug companies are about stepping on patents. Otherwise, shut up, sit down and stop whining.

It could be stated an other way

"You go and put together a new drug formula, and because it's software and MAY HAVE touched SCO UNDEFINED IP, if you're not careful, that gets destroyed."

If Darl were really concerned about the dangers of licenses, contracts and patents he would just stop claiming stupidities over and over again. But he is only concerned by the poorly deserved money he can get.

He claims he was just sampling them to see if they had any SCO IP in them.

Patent vs. Copyright

Forget for a moment the myriad ways he mischaracterizes the GPL. In this instance, he has a copyright license somehow destroying patents. That's
truly ludicrous. Drug formulas don't fall under copyright law at all.
They fall under patent law. A drug formula must be revealed for FDA and patent approval. It's not a secret in any way. And is protected by an
entirely different part of the law.
