Microsoft Asks Court to Level Fine Against Lindows, Inc. (Newsalert)

Microsoft is making an attempt to levy a large fine from Lindows, Inc according to this press release. "Lindows, Inc. has received copies of papers filed against the company in the Netherlands by Microsoft Corporation asking the court to fine Lindows 100,000 euros per day for permitting its website to be reachable by visitors from the Benelux countries (Netherlands, Belgium and Luxembourg)."

What I always found a bit odd, this was just a Dutch case, yet the ruling also affects citizens of Belgium (not part of the Netherlands anymore for the last 173 years) and Luxembourg. Hey, maybe we can have a Belgian judge rule that all of the people in the Benelux can visit the Lindows site! That would be fun!

I have read somewhere that there is an agreement between the 3 countries
wich allows the Dutch judge to rule for Belgium, Netherlands and Luxembourg.
I suppose it is part of some treatee that were signed to form the BeNeLux.

In 1948, Belgium, the Netherlands and Luxemburg signed the Benelux treaty. One of the results of this cooperation was a single trademark law and office for all three countries. Because of this a judge in either of the countries can declare a trademark infringement illegal in the entire Benelux.

Why is it that everything Robertson touches turns to reduced value for his customers? If MS wins this, that's money Robertson isn't going to be able to use for Linux work.

Hmmm, there is a warning. Not only when I'm accessing www.lindows.com from the Netherlands, but also from a German IP-Address. Did they adjust their website because of this threath from M$?

M$ knows that it's impossible to block access to websites selectively so this is an attempt to bankrupt Lindows.
