He's the one who got paid for *programming* something, but instead *copied* the works of somebody else, pretending it was his own. Where I work the policy is clear: you have to go through a one-day seminar on OSS and Licensing to make sure you understand the issues and consequences if you want to work with OSS in general. And there is a rigorous review process (including lawyers) if you decide to either use OSS for/with/in/bundled with/linked to a proprietary product, or if you decide to make a proprietary product open source.
