If there is a contract that says Novell will not compete with SCO, McBride may have a point here. The exact text of the contract is interesting, as it allowed Novell to compete SCO with their Novell system.

Novell sells products & do support - it has IT business. SCO has no business left at all. And since Novell doesn't fill heaps lawsuits every day - so it doesn't compete with SCO ;-) Structly speaking - you are right.
