I think the cleverest thing about this is the name. As far as I can see, US politics is mostly about marketing, and who could argue with Defending Innovation? Why, anyone who did would sound positively unpatriotic!
Perhaps they even stand a chance of success...

It's the EFI. Likelihood of success is low.
Besides that: The USA government is increasingly becoming more and more totalitarian. Elimination of software patents means losing some part of the control the government has over industry. Giving up power voluntarily is against the nature of state government; This is pretty much a universal truth.
