This article at rediff.com takes a look at Linux and current battles. "Microsoft is feeling the heat from Linux, as the free operating system is improving by leaps and bounds. Unix itself, which could, at one time, have stopped the Microsoft juggernaut in its tracks, was doomed by a schism in the ranks, which pitted Sun Microsystems and AT&T against IBM, DEC, HP, etc. I was in the thick of that battle, and I now see we were irresponsible to fight internecine battles, trying to push our own versions of Unix, while Microsoft ran away with the prize: control over the desktop, and the untold billions that comes with it." I found a little paranoia in the article about microsoft funding SCO for FUD, but the first link (http://www.pbs.org/cringely/pulpit/pulpit20030828.html) enlight me on what MS idea of competition ..

" It isn't that Microsoft needs so much to win, but that they are desperate not to lose. The company functions in part by encouraging paranoia. "Sure things look good now, but that could change in an instant." That was Microsoft's primary defense in its case with the Department of Justice -- not that it didn't have an effective monopoly, but that it had what it thought was a fragile monopoly. That's why Microsoft needs a war chest of nearly $50 billion because that instant could come and the cash would be needed. "

This article is 28/8/2003 do not appear in LWN because is not GNU/Linux related .. But if you are a GNU/Linux-supporting software maker you should be warned: do not work with MS

This is a bit long, just to ask one simple question, but please bare with me.

SCO orginal complaint was against IBM accusing IBM of giving code to the Linux Project that IBM did not own. It has since the time of the orginal complaint, filed a second complaint against IBM and targetted linux users (in general) for monetary compensation. Yet SCO has not shown to the
public any code.Yes, there was the NDA thing which a few people were
shown, and the code bits at SCO's Unix affair but no real showning of the offending code to the public.

SCO reasoning is the if the alleged code is shown, the open source community will rewrite the code and they will have no grounds for thier suit. And the open source commuinty has affirmed that if and when the affending code is revealed and it does prove to be code that belongs to
SCO and not something that has found it's way into SCO's code base from another open source project or open reference then they will change the code.

We are talking about Linux; an open source code project, that to my understanding can be traced back to the first version that Linus placed
on the web.

It seems to me that if all SCO want to do is to protect it's property rights all SCO would need to do is is hire an independed organization to down load catalogue and print all version of the linux kernel that they claim are infrenging on thier copyright. To my none legal mind this would provide any evidence that a court of law would need to determine guilt.
IS this assumption wrong, if so what am I missing?

I, as many others, see SCO moviatives are pure greed. It make me wonder if their lack of cooperation with the open source community will cause
them more harm if and when this case comes to trial.
