Isn't it the whole point of TCP - Adapting the bitrate to the bandwidth of the underlying link ?

As shown by the bufferbload issue, TCP isn't doing a very good job in adaptating itself to the bandwith, so using different policy for different type of connection is sensible (well granting a patent for this is insane, but that's a different issue).

No, because TCP doesn't affect the data itself. This is about, for example, encoding an audio stream at a different bitrate so that less data is actually transferred.
