But wait, hasn't the system been changed recently to "first to file"? Wooot! I think I will fill anyway, and sue those bastar...I mean...gentlemen to death!

Our new first to file doesn't help you there: Their prior public practice of the technique would preclude your patent.
People, quick to assume the worst of any regulatory change, often make out f2f as worse than it is. At least for us in the open world who constantly make our inventions public shortly after their conception and don't depend on patents its not something that has that much impact.

Well, Samsung was suing Apple to get an injunction against selling IPads, which contain lots of Samsung chips... That's getting close to suing themselves :)
