A tragically American perspective: That government is the problem and nothing else... like, say, companies (and their representative bodies) that hold vastly more financial, geographical and political power than many governments (and influence over the actors within government to match).
The 'net is a commons built on private infrastructure. Yes, government may cause the occasional problem, but our Internet freedom is mostly in the hands of (terribly regulated, particularly in the USA) corporate interests.

Moglen did not restrict his criticism to that of government. He was equally critical of corporations. Though, corporations perhaps engage less in the "ripping off of people's fingernails", as he mentioned in the talk. The "military-industrial complex" comprises both sectors.
