It may be that SCO is still exercising its Corporate Freedom of Speech. The First Amendment allows corporations to say anything they want, with no requirement that it be true.

Free Speech

Commercial speech in the US is more limited that of individual, personal expression. Note that both have limitations. However, I would imagine that SCO's lawyers are coaching the executives carefully on what they can and cannot say.
