Con Zymaris explains how the Australian Trade Practices Act is being used against SCO in this Linux Journal article, and encourages similar action worldwide. "You should alert your consumer watchdog that you believe that SCO is entering into conduct both misleading and deceptive to all Linux users in your country. It may be that SCO is still exercising its Corporate Freedom of Speech. The First Amendment allows corporations to say anything they want, with no requirement that it be true.

Commercial speech in the US is more limited that of individual, personal expression. Note that both have limitations. However, I would imagine that SCO's lawyers are coaching the executives carefully on what they can and cannot say.
