This is GPL'd code released under that license by Oracle. What do you think they could do? They can't assert patent rights due to their own release.

SCO never tried to assert patent rights to anything.
And what they *did* try to assert just ended up with them laughed out of court and bankrupt; if there was a strategy there, it was a mixture of wild optimism and cynical conmanship. What would Oracle gain from that sort of nonsense?
