Free Software friendly patent pools

I wouldn't be surprised if that was one of the alternatives that Google's negotiators suggested as part of the negotiations that broke down, resulting in this case. (Google lawyers probably spent the time between the On2 acquisition and the WebM release quietly paying off the best-positioned video compression trolls.) Did they not offer enough, or did the idea of a widespread, free almost-Java offend someone's aesthetic sensibilities?
