Sun expands Unix deal with SCO (News.com)

News.com looks into deals between Sun and SCO. "The pact, signed earlier this year, expanded the rights Sun acquired in 1994 to use Unix in its Solaris operating system. But there's more to the relationship: SCO also granted Sun a warrant to buy as many as 210,000 shares of SCO stock at $1.83 per share as part of the licensing deal, according to a regulatory document filed Tuesday."

"We're in the process of registering them with the Copyright Office," Stowell said. "We expect it to be completed within about six months." The reason it takes so long is that SCO must show the sequence of ownership of the copyrights.

This is actually the most disturbing part of the whole article. I hope ESR, Dennis Ritchie (who I believe posted some documents about the USL vs. BSD case recently) are paying attention here. SCO could be violating that settlement, but if the US Copyright Office is anything like the USPTO, then they just might get away with this. Is someone stepping forward to demonstrate that SCO cannot legally lay claim to the source code specified in that settlement? I hope there is a process in place for contesting a copyright claim.

Indeed. BSDI is now owned by Windriver... not sure how worried or not they are. I suspect the UCB has probably lost interest... So who would be in a position to check this IP land grab? Do Novell still have an interest?

Or MacNeal have lost it,... another dark secret deal to say the least... or there is a "SCAM" at the "HIGHEST LEVEL" in all this SCO "thing"...

That is "they" are planing to legaly stop Linux FS/OSS, wich i dont see how, or they are going crazy... because is pretty clear now that Linux FS/OSS is enormously hard do dismiss, by FUD, because of a very pro-active user base... its not everyone software, but its user base is steadly groing with new pro-active persons,... not the masses of Murphy's Law scared ones...

This might turn out to be a mistake for Sun. In getting cozy with SCO, Sun is backing a losing horse, and this news is likely to annoy many of the techies in the Unix/Linux world that have a large say in hardware buying decisions (and if you look at sysadmin responses on Slashdot about this news, you'll see what I mean - blade server proposals being dropped, for example).

It appears that McNealy still does not have the vision to foresee the inevitability of the inexorable rise of GNU/Linux.

It you ignore all the FUD for the moment, and look at the facts; the big Japanese consumer electronics makers, one government after the next, etc., all adopting GNU/Linux, it's hard not to arrive at the conclusion that GNU/Linux will prevail even in the face of all the negative publicity.

McNeally, wake up! If you want Sun to survive you should take a leaf out of IBM's book. Sun needs to be a Linux-friendly hardware company, not a Unix company.

Sun has had a long history of cutting its nose off to spite its face. I think that this in 10 years time will be another one of those failed attempts. They screwed themselves over with OpenWindows, then Java, and now it looks like Solaris. I have found that many/most of the developers I know there are great people doing really cool work. The people who run the business scare sharks.

"Smith said Sun doesn't know yet if the legal protections of its Unix licenses extend to other companies' versions of Linux."

What the hell is this "protection" guy's talking about ? If SCO is right then they still are in violation of IBM's, HP's and many, many other's copyright and this license buys them nothing. If SCO is wrong (most probable case) then they do not need any license to begin with.

Plus SCO said it never granted Sun license to open-source its code so in the end they end up in violation of IBM's, HP's and so on copyrights and SCO license - "brilliant" purchase if you ask me...

Back in May, pyellman thought that Sun might have been in league with SCO. (http://lwn.net/Articles/32108/).

This will not make Sun any friends in the IT world. SCO has the freedom to make enemies because they are dieing, but Sun has to think about the long term.

Sun is a funny company because they reverse their Linux strategy every other week. In Febuary, McNealy was donning a penguin suit. A couple months later they give millions of dollars to SCO and send out nasty anti-Linux press releases. I bet they already regret that. By next fall, they will be gung-ho about Linux again.

Anyway, I can't complain. So long as Sun keeps up their Gnome and OpenOffice.org work that's what counts in the long run.
