I've found more good statements from venture capitalists than I'd expected.

The harm with neither litigation nor threats is something I'm only beginning to document. Community projects self-censure due to fear and due to lack of resources for patent wars, so the damage is done without litigation. And as free software becomes increasingly profitable, the patent holders will litigate, but the targets will be the big distributors. So free software is severely harmed, but litigation is an awful way to measure this.
