You're absolutely correct. It's one thing to say you didn't know you were shipping the code to the press, but saying that in court would be perjury. The Internet has a long memory, and I've recently seen the articles from that time posted on various boards.
SCO knowingly, willingly, and intentionally put that code in there, with a great deal of public fanfare. As the copyright holder, their authorized agents released that code as GPL.
They can whine and cry foul all they want, it's not going to change the reality of the situation.
