Maybe but not on x86 CPUs, AFAIK they all contain microcode which isn't Free..

I would be extremely surprised to find anyone who called microcode "software".

Be surprised. Microcode is software.

Yes, it runs on a lower-level infrastructure. Yes, an initial version is typically built onto the device. So what? It walks like a duck, quacks like a duck, etc.; let's just admit that it's a duck.
