One might be tempted to point out that your editor's picture got out into the world, while the professional's has never really been seen, but your editor would never think of being so petty.
From that I assume the 2008 Kernel Summit bought the photographic equivalent of proprietary software, when they should have ensured they got the rights to modify and distribute the photograph, as well as the "source code" (high-quality digital image file). (photographers usually sell their time cheap, and then get their money from selling copies of their photographs separately)
Ironic...
