"If a private key is considered part of the program's installation scripts, there could be a problem."

The only so-called problem is that the private key must be provided as well. Thus making it useless as Linus pointed out. So it is problem to the distributor not anyone else. If the binary doesn't impact the GPL then it essentially becomes a license manager to the software or hardware to talks to.
