Didn't the RIAA and/or MPAA make an agreement with the BSA recently that would affect this? As I recall, it went something like that the former would not push for CBDTPA-like laws, and the latter would stand with them in resisting expansions of fair use.

It seems that any effort of the RIAA/MPAA to make Gnutella etc. illegal would run afoul this agreement. It was, as I understood it, a handshake agreement, but anulling it would nonetheless cost the RIAA/MPAA a formidable ally.
