Map ownership is not restricted. Map creation is. It's kinda hard to point to someone who owns the license (granted by Russian government) for OSM... All other maps (especially printed ones but also Google Maps or Yandex Maps) have pointer to someone who owns the license. That being said I'm pretty sure induvidual users will not be jailed, but Linux distributors who include OMS data on the CD... that's another question altogether :-)
