According to the GPL (Section 3, last paragraph): "In addition, mere aggregation of another work not based on the Program with the Program (or with a work based on the Program) on a volume of a storage or distribution medium does not bring the other work under the scope of this License." You may not be able to stick the firmware in the driver as a hex constant, and the firmware license may prohibit redistribution, but distributing it alongside the driver is explicitly permitted by a plain reading of the GPL.
