The definition of a Red Hat Brand is:
"Red Hat Brand" means a trademark, service mark, trade name, or brand owned, exclusively licensed, or controlled, now or in the future, by Red Hat.
So, yes, Red Hat's ownership of the Fedora trademark suffices; I confirmed this with Red Hat just to be sure. They agreed they should have been more clear about this aspect of the agreement at the initial announcement.
