This is the way copyright law works regardless of what Linux developers or the FSF might wish for.

My understanding is that's not strictly true either. Copyright law (indeed, all law) works the way a given judge deems it to work. Lawyers can have varying opinions on which way a judge is likely to rule in any given area, and advise their clients accordingly. The FSF have one view on that here, and you have another. Since both you and the Eben Moglen et al are far better versed in legal matters than I am, I'll defer to your judgement. But given that you appear to have differing opinions here, whose do I trust? Surely ultimately it comes down to how the judge rules when the issue gets its day in court? Isn't anything else just (informed) opinion?

Perhaps Eben Moglen will speak up himself rather than be quoted (or perhaps misquoted)?
