I think the reason behind it is that Creative are not allowed to have their drivers opened up in this way because of their agreement with Microsoft and the DRM requirements of Vista. But that's not what Creative said in its public reprimand of the modder, even though it would have been easier to defend than the property right issues that Creative apparently believes are at stake.
