Of course, liability laws might be written to exclude programs given away for free, or they might concern themselves with vendors and leave individual developers out of the picture. I think another option would to be exclude vendors who provide a copy of their source code for their customers to verify and fix for themselves, but to hold liable companies who prevent these actions with proprietary software.
